Artists Within Makeup Academy offers this website, including all information, tools, courses, and services available through this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing any product or service from us, you engage in our "Service" and agree to be bound by the following Terms of Service, including any additional terms, conditions, and policies referenced herein or available by hyperlink. These Terms apply to all users of the site, including browsers, customers, students, and contributors of content.

Our store is hosted on Shopify Inc., which provides us with the e-commerce platform through which we sell our products and services.

 

By agreeing to these Terms of Service, you confirm that you are at least 18 years of age (the age of majority in the Province of Alberta), or that you have provided consent for any minor dependents to use this site.

You may not use our products or services for any illegal or unauthorized purpose, nor may you violate any applicable laws in your jurisdiction, including but not limited to copyright laws.

You must not transmit worms, viruses, or any code of a destructive nature.

A breach or violation of any of these Terms will result in immediate termination of your access to our Services.

 

We reserve the right to refuse service to anyone for any reason at any time.

Credit card and payment information is always encrypted during transfer over networks.

Shipping

Artists Within Makeup Academy ships from Alberta, Canada. Shipping fees are charged at checkout and are non-refundable once an order has been fulfilled and dispatched, regardless of the reason for return.

International Orders — Duties, Taxes & Customs Fees

For orders shipped internationally, including orders shipped to the United States and all other countries outside of Canada, import duties, customs fees, brokerage charges, and applicable destination-country taxes are the sole responsibility of the buyer.

These charges are assessed and collected by the destination country's government or customs authority. Artists Within Makeup Academy has no control over these fees, cannot predict their amount, and is not able to reimburse, cover, or waive them under any circumstances.

By placing an international order, you acknowledge and accept full responsibility for any duties, customs fees, or related charges that may be assessed upon delivery.

Refused Delivery

If a shipment is refused at delivery due to unpaid duties, customs fees, or for any other reason, the order will be returned to us. Upon receipt of the returned package in new, unopened, and unused condition, a refund will be issued for the product cost only. The original shipping fee and any return shipping or brokerage fees charged to Artists Within Makeup Academy as a result of the refusal will be deducted from the refund total.

 

We reserve the right to refuse or cancel any order placed with us. We may limit or cancel quantities purchased per person, per household, or per order. In the event of an order change or cancellation, we will attempt to notify you via the contact information provided at the time of purchase.

You agree to provide current, complete, and accurate purchase and account information for all transactions made through our store.

 

All online courses, digital downloads, videos, lesson content, and educational materials available through this website are the sole intellectual property of Artists Within Makeup Academy. All rights reserved.

Upon purchase of an online course or digital product, you are granted a limited, personal, non-transferable, non-exclusive licence to access and use the content for your own personal learning purposes only. This licence does not permit you to:

•       Share your login credentials or grant access to any other individual

•       Copy, reproduce, distribute, or resell any course content in any format

•       Record, screenshot, or otherwise capture proprietary course materials for redistribution

•       Sublicense, transfer, or assign your access rights to any third party

Violation of these terms will result in immediate termination of access without refund and may result in legal action.

All Artists Within Makeup Academy course content, branding, curriculum, techniques, and materials remain the exclusive intellectual property of Artists Within Makeup Academy.

 

All returns and refunds are governed by our separate Return & Refund Policy, available on our website. Key terms include:

•       Physical products must be returned in new, unopened, and unused condition within 14 days of purchase.

•       AW03 Pro and Starter Makeup Kits associated with students or industry insiders do not qualify for refunds. Damaged or defective items will be replaced at no cost if reported within 14 days.

•       Online courses will be refunded only if the student has not logged in and the request is made within 14 days of purchase.

•       Shipping fees are non-refundable in all circumstances.

•       International customs fees and duties are not grounds for a refund of shipping costs.

Artists Within Makeup Academy operates regulated diploma programs in the Province of Alberta under the Private Vocational Training Act. All diploma program enrolments are governed by the Alberta Student Enrolment Contract provided to each student upon registration.

By enrolling in a diploma program, you agree to be bound by the terms of the Student Enrolment Contract, including all withdrawal, termination, and refund provisions set out in Section 13 of the Private Vocational Training Regulation.

Deposits

Deposits paid for diploma programs are non-refundable. Start dates may be transferred to a future intake, subject to availability for a transfer fee of $50.00, provided written notice is given prior to the program commencement date.

Withdrawal & Termination — Tuition Refunds

If written notice to terminate enrolment is received after the program has commenced, tuition fees are payable as follows:

•       25% of total tuition fees if written notice is given after 10% or less of the program has been delivered.

•       60% of total tuition fees if written notice is given after more than 10% but less than 50% of the program has been delivered.

•       100% of total tuition fees if more than 50% of the program has been delivered before written notice is given.

These provisions are consistent with the requirements of the Private Vocational Training Regulation (Alberta). Please refer to your Student Enrolment Contract for the complete withdrawal and termination policy.

 

We may provide access to third-party tools and services through our website. These are provided "as is" without any warranties or endorsements from Artists Within Makeup Academy. Any use of third-party tools is at your own risk.

Third-party links on this site may direct you to websites not affiliated with us. We are not responsible for the content, accuracy, or practices of any third-party sites and encourage you to review their terms and policies independently.

 

By submitting content to us, including feedback, reviews, contest entries, ideas, or other materials, you grant Artists Within Makeup Academy a non-exclusive, royalty-free right to use, publish, and distribute that content in any medium without compensation or obligation.

You are solely responsible for the accuracy and legality of any content you submit. You agree that your submissions will not contain unlawful, abusive, defamatory, or harmful material and will not infringe on the rights of any third party.

If you submit photography or video content for testimonials or promotional use, you grant us permission to use your likeness in connection with our marketing materials unless you advise us otherwise in writing.

 

Your submission of personal information through our store is governed by our Privacy Policy. 

 

Occasionally, there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors or inaccuracies and to cancel orders where information was inaccurate at the time of purchase, without prior notice.

 

In addition to other restrictions set out in these Terms, you are prohibited from using this site or its content:

•       To violate any international, federal, provincial, or local laws or regulations

We reserve the right to terminate your access to the Service for any violation of these prohibited uses.

 

Artists Within Makeup Academy monitors return activity for patterns of abuse or potential fraud. If we determine that a customer is engaging in excessive, abusive, or fraudulent return behaviour, that customer will be notified in writing that we will no longer accept returns from them, with or without a receipt.

 

We do not guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. The service and all products and services are provided "as is" and "as available" without warranties of any kind, express or implied.

To the fullest extent permitted by applicable law, Artists Within Makeup Academy, its directors, officers, employees, affiliates, agents, and service providers shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of our service or products — including lost profits, lost revenue, loss of data, or replacement costs — whether based in contract, tort, or otherwise.

Where applicable law in certain provinces or territories does not allow the exclusion or limitation of consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.

 

You agree to indemnify, defend, and hold harmless Artists Within Makeup Academy and its directors, officers, employees, affiliates, agents, contractors, suppliers, and service providers from any claim or demand, including reasonable legal fees, made by any third party arising from your breach of these Terms of Service, your violation of any law, or your infringement of the rights of any third party.

 

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be severed from these Terms without affecting the validity of the remaining provisions.

 

These Terms of Service are effective unless and until terminated by either party. You may terminate at any time by notifying us that you no longer wish to use our services, or by ceasing to use the site.

If we determine, in our sole judgment, that you have failed to comply with any provision of these Terms, we may terminate this agreement and deny you access to our Services at any time without notice. You will remain liable for all amounts owing up to and including the date of termination.

 

These Terms of Service, together with our Return & Refund Policy, Privacy Policy, and any other policies posted on this site, constitute the entire agreement between you and Artists Within Makeup Academy and govern your use of the Service. They supersede any prior or contemporaneous agreements, whether oral or written.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

 

These Terms of Service and any separate agreements through which we provide you services shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta.

 

We reserve the right to update, change, or replace any part of these Terms of Service at any time by posting updates to this page. It is your responsibility to review this page periodically. Your continued use of our website or services following the posting of any changes constitutes your acceptance of those changes.
